1. Provider and scope
The provider and contracting party is Özgür Ergezgin, trading as Upgrade Force Systems, Kollwitzstr. 76, 10435 Berlin, Germany, email: support@legendsunchained.de (the “Provider”). These Terms apply to legendsunchained.de, the browser game Legends Unchained® and all related account, profile, community, communication, clan, ranking, minigame and shop features. Different terms apply only if the Provider expressly accepts them.
2. Contract formation and incorporation of these Terms
Before registration is submitted, users are expressly informed of these Terms. Users can open, save and print the linked document and accept it through a separate mandatory checkbox. The Privacy Policy separately explains data processing and is not contractual consent. Paid contracts are formed only as described in the relevant checkout; price, scope and duration are displayed before an order is placed.
3. Service, testing phases and availability
Legends Unchained is an online service requiring a supported browser, suitable hardware and software and an internet connection. It may include missions, dungeons, PvP, ages, inventory, companions, rankings, clans, messages, minigames and future shop or marketplace features. Alpha, beta and other testing phases are for evaluation; content, values and progress may be changed or reset. Continuous, error-free availability is not promised. Maintenance, updates, security measures and incidents may temporarily restrict access.
4. Registration, accounts and credentials
Registration details must be accurate and kept current. A person may operate only the accounts and profiles expressly allowed. Credentials must be kept confidential and suspected misuse reported immediately. Accounts may be global while profiles and progress may be server-bound. Users are responsible for actions originating from their sphere of control. Selling, buying, renting, sharing or transferring accounts is prohibited unless expressly authorised.
5. Minors and age protection
The age requirements stated in the service apply. Minors may register and enter paid contracts only where permitted by law and with any required parental consent. The Provider may request appropriate age or consent evidence and restrict features where needed to protect minors.
6. Game rules and fair play
Users must play fairly and respectfully. Cheating, bots, unauthorised scripts or automation, manipulation of the client, communications or data, multiple accounts used to evade limits, exploiting or distributing bugs, match fixing, real-money trading outside authorised features, phishing, fraud, impersonation, spam and interference with or attacks on the service are prohibited. Bugs and security issues must be reported confidentially to support@legendsunchained.de and must not be exploited.
7. Communication, clans and user content
Names, profile text, chat, messages, clan descriptions and other user content must comply with the law and these Terms. Illegal, abusive, discriminatory, hateful, threatening, pornographic, harmful-to-minors, fraudulent or rights-infringing content and unauthorised third-party personal data are prohibited. Users retain rights in their content and grant the Provider a non-exclusive, worldwide licence, limited to the duration of use, to host, display, moderate and technically provide that content only as required to operate the service.
8. Reports, moderation and complaints
Content and conduct may be reported and reviewed. The Provider may remove, hide or reduce the visibility of content or restrict account features where necessary for law, these Terms, security or the protection of others. Where applicable, affected users will receive information on significant moderation decisions and their reasons and have an internal contact or complaint route. Mandatory notice, reasoning, complaint and out-of-court redress rights, including under the Digital Services Act, remain unaffected.
9. Virtual currencies and items
Gold, diamonds, chips, honour, items, VIP, boosters, cosmetics and other game values are virtual elements of the service. They are not legal tender, earn no interest, have no guaranteed value outside the game and generally cannot be redeemed for cash or transferred outside authorised features. Acquisition grants a limited right of use, not ownership of software or data. Transfers may be reviewed, limited or reversed to prevent abuse, correct errors and preserve game balance, subject to mandatory law.
10. Paid content, prices and payment
If diamonds, VIP or other digital content or services are offered for payment, checkout will show the total price, essential features, duration, payment terms and any recurring renewal before the order. External payment providers may be used. Digital benefits are activated after successful payment unless the offer states otherwise. Statutory rights concerning non-supply, lack of conformity and defects in digital products remain fully available.
11. Right of withdrawal
Consumers may have a statutory right of withdrawal for distance contracts. The applicable withdrawal information and model form are available on the “Withdrawal” page and will be supplied before paid contracts are concluded. Immediate performance of digital content or services and any early expiry of the right of withdrawal will occur only after the legally required separate requests, consent and acknowledgements. Free account registration is not itself a paid purchase.
12. Random mechanics and minigames
Random mechanics do not guarantee a particular outcome. Stakes and rewards use only values identified within the game and cannot be paid out in cash. Probabilities, rewards, limits and requirements may be adjusted for balance, error correction, security or prevention of abuse. Information required by law will be displayed in the relevant feature before use.
13. Updates, changes and maintenance
The Provider may deploy updates, patches, security measures and balancing changes. Content, features, rules and the game economy may be adapted, replaced or discontinued for technical, legal, security or gameplay reasons where reasonable after considering user interests. Paid digital products remain subject to statutory update and modification rules and any required advance information.
14. Errors, rollbacks and corrections
Technical errors, rollbacks and data inconsistencies cannot be completely excluded. Incorrect progress, transactions, rankings or virtual items may be corrected where necessary and reasonable to restore a proper state. Confirmed game actions are generally not reversed solely because of user error unless mandatory rights apply or the Provider grants a discretionary remedy.
15. Warnings, suspensions and termination
Depending on the nature, severity, repetition and fault involved, breaches may result in notices, warnings, removal of content, feature restrictions, correction of virtual values, temporary suspension or permanent account closure. Serious fraud, cheating, exploits, real-money trading or attacks may justify immediate termination. Users may terminate or request deletion through an available feature or by emailing support@legendsunchained.de. Statutory retention duties remain unaffected.
16. Discontinuation of the service
The Provider may discontinue the service for legitimate economic, technical or legal reasons. Where possible and reasonable, users will receive appropriate advance notice. Statutory refund, remedy and termination rights apply to paid services not fully performed. Free earned values do not create a right to cash payment or transfer unless mandatory law provides otherwise.
17. Intellectual property
The game, software, graphics, texts, audio, brands, logos and databases are protected. For the duration of the relationship, users receive a personal, non-exclusive, revocable and non-transferable right to private use within the intended features. Copying, distribution, commercial exploitation, reverse engineering or circumvention of technical protection is prohibited unless permitted by law or expressly authorised.
18. Liability and privacy
The Provider has unlimited liability for intent, gross negligence, death or personal injury and under mandatory law. For slight negligence affecting an essential contractual duty, liability is limited to typical foreseeable damage; otherwise liability for slight negligence is excluded where lawful. The separate Legends Unchained® Privacy Policy explains the processing of personal data.
19. Amendments, governing law and final terms
These Terms may be amended for objective reasons such as new law, case law, features, security needs or business models. Users will be informed in good time of material changes and express consent will be obtained where required. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers retain mandatory protection under the law of their habitual residence and statutory courts have jurisdiction. If a provision is invalid, the remaining provisions stay effective.
